(“Orca,” “we,” “us,” or “our”) have created this privacy policy (this “Privacy Policy”) because we strongly respect your rights to privacy and we are committed to keeping secure any information we obtain from you or about you. This Privacy Policy relates to the information collection and use practices of Orca in connection with our websites located at https://orcadb.ai/ (“Website”), and our proprietary software and services platform (“Platform”) made available through the Website.

1. Scope of this policy

The Website and the Platform are operated by Orca in the United States (US), and comply with US law. If you are located outside of the US, please be aware that any information you provide to us may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your home country, where the data protection laws may not be as protective as those in your jurisdiction.

2. Description of Users and Acceptance of Terms

This Privacy Policy applies to visitors to the Website who view only publicly-available content (“Visitors”), and subscribers who have signed up to access and use either the free or fee-based Platform services (“Subscribers”).

By visiting or accessing our Website, Visitors and Subscribers are agreeing to the terms of this Privacy Policy and the accompanying Master Service Agreement.‍

By signing up, accessing, or using our Platform, each Subscriber agrees to the terms of this Privacy Policy, the accompanying Master Service Agreement, and any applicable subscription agreement that governs your use of the Platform (the “Subscription Agreement”). In the event of a conflict or inconsistency between this Privacy Policy and the Terms of Use, and the Subscription Agreement, the Subscription Agreement shall control.

Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in the Master Service Agreement.

3. Personal Data Orca Collects

‍In the course of operating the Website and the Platform, Orca collects or receives the following types of information related to you (“Personal Information”):

Personal Information You Provide:

• Contact Information: When you register to receive a demo, sign up directly or through email and other indirect messages to become a Subscriber, contact us using the “Contact Us” page, send in a customer support request, sign up for a mailing list, register to attend a training workshop or event, or apply for a job at Orca through our Website or Platform, as applicable, you will be asked to provide certain information necessary to complete the task which may include your name, e-mail address, job title, account image, company name, country, state/region, and phone numbers (fax, cell and/or landline) (collectively, the “Contact Information”).
• Billing Information: In order to purchase a subscription for full access to the Website and the Platform, you will be required to provide certain additional information, which may include the name of your bank, a banking account number, bank routing number, credit card number, expiration date, billing zip code, activation code and/or similar information (“Billing Information”).  Billing Information is collected and processed by our third-party payment processor operating as our agent.  We do not directly obtain, store, access, or otherwise process any Billing Information.

Personal Information Orca Automatically Receives from Your Use of the Services:

• Usage Data via Third-Party Analytics Providers: In order to continue to improve the user experience of the Website and the Platform, Orca may use one or more third–party analytics services to evaluate your use of the Website and the Platform, as the case may be, by compiling reports on activity (based on their collection of IP addresses, Internet service provider, browser type, operating system and language, referring and exit pages and URLs, data and time, amount of time spent on particular pages, what sections of the Website and the Platform you visit, number of links clicked, search terms and other similar usage data) and analyzing performance metrics.
